Welcome to MicroplastX. These Terms and Conditions ("Terms") govern your use of the website www.microplastx.com (the "Site") and the purchase or use of any products or services offered by Microplastix ("MicroplastX," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the Site or purchasing a MicroplastX product, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), that you have the legal capacity to enter into this agreement, and that you accept and agree to comply with these Terms, our Privacy Policy, and our Refund Policy.

2. Products and Services

MicroplastX provides an at-home microplastics test kit and related educational resources, partner offerings, and community access. Our test kit includes a blood collection kit, prepaid return envelope, and supplies needed to collect and return a sample for laboratory analysis at a CLIA/COLA-accredited facility.

Test results are intended for informational and educational purposes only. MicroplastX results are not a medical diagnosis and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider with any questions about a medical condition.

3. Orders, Pricing, and Payment

  • All prices are listed in U.S. dollars and are subject to change without notice.
  • We reserve the right to refuse, cancel, or limit any order at our sole discretion, including orders that appear fraudulent, mispriced, or in violation of these Terms.
  • Payment is due in full at the time of order. We accept major credit and debit cards and other payment methods displayed at checkout.
  • You represent that any payment information you provide is accurate and that you are authorized to use the payment method submitted.

4. Shipping and Delivery

We ship test kits within the United States. Estimated delivery times are provided as a courtesy and are not guaranteed. Risk of loss passes to you upon delivery to the carrier. Laboratory turnaround for results is typically 2–3 weeks after the lab receives your sample.

5. Sample Collection and Use

You are responsible for following the instructions included with your kit. By submitting a sample, you grant MicroplastX and its laboratory partners the right to process, analyze, and store your sample and the resulting data for the purposes of providing the service, internal quality control, and aggregate, de-identified research. We do not sell your individual personally identifiable data. See our Privacy Policy for details.

6. Account Registration and Community Access

If you create an account or join the F*ck Aging community, you are responsible for keeping your login credentials secure and for all activity that occurs under your account. You agree not to misuse community resources, harass other members, or post content that is unlawful, infringing, or harmful.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, videos, and software — is the property of MicroplastX or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission.

8. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law;
  • Attempt to gain unauthorized access to our systems or interfere with the Site's operation;
  • Resell, redistribute, or commercially exploit MicroplastX products or test results without our written consent;
  • Submit false or misleading information in connection with an order or sample.

9. Disclaimers

The Site and all products are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. MicroplastX does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, MicroplastX, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the Site or any product purchased through the Site. Our total aggregate liability shall not exceed the amount you paid for the product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless MicroplastX and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site or products, or your violation of any law or third-party right.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
